General Sales Conditions applicable as of 01/01/2024

“Ushuaïa Villages” is a brand operated by SAS USV.

These general terms and conditions define the respective obligations of USHUAIA VILLAGES, a brand operated by the company USV, and the CUSTOMER within the framework of the sale of USHUAIA VILLAGES HOLIDAY(S) on the SITE or by telephone. Any deviation from these terms and conditions must be agreed to in writing by USV prior to booking the USHUAIA VILLAGES STAY(S). Any special conditions signed between USV and the CLIENT will prevail over these general conditions in the event of contradictory stipulations.

USV is represented by its Managing Director: Olivier LACHENAUD.

1 - Definitions

When used in these terms and conditions in capital letters,

the following terms shall have the meanings set out below:

“CUSTOMER(S)” : Non-professional customer(s) in the territory of the European Economic

European Economic Area;

“STAY(S)” : Rental stay(s) designed and sold by USHUAIA VILLAGES, a USV brand, for the CLIENT(S).

“SITE": www.ushuaia.villages.com

The seller, USV, a Société par Actions Simplifiée with capital of 10,000 Euros, registered under number 981 161 516 with the PARIS trade and companies register, whose head office is located at 10 Villa d'Eylau - 75116 PARIS - France.

2 - Scope and territoriality of the offer

The HOLIDAY offers are exclusively reserved for private individuals. USV reserves the right to change, at any time and without notice, the HOLIDAYS offered in its paper and electronic catalogs.

3 - Ordering

3.1 All contracting parties must be at least 18 years of age and have the legal capacity to enter into a contract, and must not be under guardianship or curatorship. The contracting party must be present for the entire duration of the stay.

The reservation is only effective with the agreement of the campsite, after receipt of the deposit and after receipt of either the reservation contract duly completed and signed, or after acceptance of the general conditions of sale when booking online.

Reservations for camping pitches or rentals are made on a strictly personal basis. Under no circumstances may you sublet or assign your reservation without the prior consent of the campsite.

Minors must be accompanied by their parents or legal guardians.
3.2 Camping pitches: The basic package includes a pitch for a tent, caravan or camper van for 1 or 2 people, access to sanitary facilities and reception facilities.

Rental: Rental accommodation is fully equipped. The basic package is for 2 to 8 people, depending on the type of accommodation.

Ushuaïa Villages reserves the right to refuse access to the campsite to groups or families whose number of participants exceeds the capacity of the rented accommodation.

3.3 In accordance with the provisions of article L.113-3 of the French Consumer Code and articles L.211-8 and L.211-9 of the French Tourism Code, these general terms and conditions are made available to all CLIENTS, for information purposes and prior to the conclusion of any contract for the sale of STAY(S). They may also be obtained by writing to USV: 10 Villa d'Eylau - 75116 PARIS - France.

3.4. Each CLIENT acknowledges having read these terms and conditions prior to booking a STAY, for him/herself and for any person taking part in the STAY.

3.5. The CLIENT places an order on the SITE or by telephone on +33 2 52 56 03 99. Any order for a STAY implies the CLIENT's express acceptance of the rates and these general terms and conditions. A processing fee of twenty euros is charged for each reservation, unless otherwise stated on the site or unless there is an exceptional discount.

3.6. If USV contacts you by telephone, it will send you a written offer, which you may sign and return to USV, thereby validating the order. If it is the CLIENT who takes the initiative to contact USV by telephone, the CLIENT's verbal agreement is sufficient to validate the order.

3.7. On the SITE, the reservation of a STAY can only be recorded if the CLIENT is clearly identified and has created an account.

3.8. To be valid, the order must specify the references of the STAY(S), including the place(s) and date(s), as well as the agreed price and payment terms.

3.9. Once the total amount of the order has been received, or once the initial deposit has been paid, the CLIENT will receive an order confirmation by e-mail, summarizing the contact details of the USHUAIA VILLAGES STAY, the details and number of the order, and the terms of payment.

3.10. Right of withdrawal: USV wishes to remind you that, in accordance with Article L. 121-20-4-2 of the French Consumer Code, the right of withdrawal does not apply to accommodation, transport, catering and leisure services provided on a specific date or at a specific time. Consequently, all orders placed on our website or with one of our vacation advisors are not subject to the right of withdrawal.

4 - Availability

Each STAY may be booked subject to availability on the campsite. In the event of unavailability of a STAY, USV will inform the CLIENT in writing within three (3) working days from the date of validation of the order. If necessary, USV will offer the CLIENT an equivalent STAY in writing, which the CLIENT may also accept or refuse in writing. Upon receipt of the CLIENT's written refusal of an equivalent STAY, or in the absence of an offer of an equivalent STAY on the date of the written notice informing the CLIENT of the unavailable STAY, the CLIENT's order will be cancelled and the sums paid will be reimbursed without delay and within fourteen (14) days at the latest.

5 - Description and accommodation

Certain activities offered by the campsites and indicated in the description available for consultation on the site may be cancelled, notably for climatic reasons, cases of force majeure, stays outside the tourist season, or when the minimum number of participants required for the activity is not reached. USV cannot be held responsible for such cancellations, nor can they be held liable for any compensation whatsoever. USV endeavors to illustrate its proposals with photos or illustrations that give a realistic idea of the proposed stays. However, please note that the photos and illustrations in the description are merely illustrative and are not contractually binding.

6 - Conditions of stay - Campsite rules and regulations

The CLIENT must comply with the rules and regulations of the campsite where he/she will be staying, which he/she will be able to read on arrival. In particular, the CLIENT undertakes to pay any security deposit required by the campsite where the stay has been booked. USV declines all responsibility in the event of exclusion by the campsite of one of its customers for failure to comply with the internal regulations. It is forbidden to exceed the maximum occupancy capacity for each type of accommodation. For obvious reasons of safety (swimming pool, possible evacuation of the campsite in the event of a weather warning) or health (possible hospitalization during the stay), minors not accompanied by one of their legal guardians within the meaning of article 389 of the French Civil Code are not admitted. Furthermore, campsites are not authorized, under the terms of decree no. 2002-883 of May 3, 2002 on the protection of minors during school vacations, professional leave and leisure activities, to provide group or individual stays away from the family home for minors under 18 years of age, unaccompanied by one of their legal guardians as defined in the previous paragraph.

7 – Image

You expressly authorize USV, without compensation, to use photographs and/or films taken during your stay for USV's communication needs. Any holidaymaker refusing to be photographed or filmed during their stay must inform USV in writing beforehand. You also authorize their distribution, publication and marketing on any type of media likely to be used.

8 - Cancellation and modification of the STAY

8.1. Any request by the CLIENT to modify or cancel the STAY must be sent to USV by email to reservation@ushuaia-villages.com or by post. Cancellation or modification of the STAY will incur the following minimum charges:

* More than 30 days before the start of the HOLIDAY: 30% of the price of the HOLIDAY + booking fees + insurance costs (if applicable);

* 30 days or less before the start of the STAY: 100% of the price of the STAY + booking fees + insurance (if taken out).

8.2. Any modification or cancellation of the STAY by USV more than three (3) working days after the date of validation of the order will be notified to the CLIENT without delay. USV undertakes to offer an alternative solution. In the event of cancellation of the STAY by USV that is not attributable to force majeure, as defined by established case law, or to the fault of the CLIENT, the CLIENT will receive compensation equal to the penalty that would have been payable under article 8.1.

8.3. Any request by the CLIENT to modify the dates of a stay/destination/type of accommodation already confirmed will result in the cancellation of the file, with the application of the fees specified in article 8.1. For all other requests for modifications, a fee of twenty-five euros will be charged.

9 - Right of withdrawal

In accordance with article L.221-28 12° of the French Consumer Code, the right of withdrawal does not apply to accommodation, transport, catering and leisure services. Orders placed via the Site are not subject to the right of withdrawal.


10 - Insurance

10.1. USV offers the CLIENT the possibility of taking out two types of optional cancellation and interruption of STAY insurance at the time of ordering, more details on : https://www.ushuaia-villages.com/assurances

In the case of a subscription to cancellation insurance, this subscription is firm, definitive and irrevocable.

USV is insured for professional liability by HISCOX FRANCE, whose head office is located at 19 rue Louis Legrand - 75002 PARIS Cedex - Contract HA PRC0375763.

The CLIENT must ensure that all claims are reported to the insurer within five (5) working days of the event giving rise to the coverage.

10.2. USV is insured for its professional liability by HISCOX FRANCE, whose head office is located at 19 rue Louis Legrand - 75002 PARIS Cedex - Contract HA PRC0375763. The purpose of this contract is to cover USV against the financial consequences of its professional civil liability in connection with the sale of STAYS.

10.3 It is specified that no insurance for the CLIENT's civil liability is included in the price of the HOLIDAYS presented on the SITE. USV therefore strongly encourages its CLIENTS to check their personal insurance coverage, and if necessary to supplement it by taking out an additional policy with their insurer, in view of the HOLIDAY booked.

11 - Prices and invoicing

The HOLIDAYS are sold at the prices in force at the time the order is placed, indicated in euros including VAT, and taking into account the VAT applicable on the day the order is placed.

USV reserves the right to modify the prices displayed on the SITE at any time, but undertakes to apply the prices in force at the time the order is placed. A processing fee will be charged for each reservation, unless otherwise stated on the site or unless there is an exceptional discount.

The prices indicated on the SITE include rental for the period and number of people indicated in the USV offer. For further details on facilities, arrival and departure times, and the security deposit, please refer to the campsite and rental descriptions provided on the SITE.

The prices indicated on the SITE do not include: taxes, paid activities offered by the campsite, additional persons, pets, rental of sheets, bicycles, safes, baby kit, etc. These additional services must be paid directly to the campsite. These additional services must be paid directly to the campsite. The prices indicated on the SITE do not, under any circumstances, include transport costs. The amount of the tourist tax varies according to the commune and is payable on arrival.

Once the STAY has been paid in full, USV will send the CLIENT an invoice and a voucher by post or e-mail. The CLIENT must hand in this voucher upon arrival at the campsite in order to use the STAY.

12 - Terms of payment

12.1 Payment of an order accepted at least thirty days before the start of the STAY :

USV provides the CLIENT with payment facilities if the order has been accepted at least 30 days before the start date of the STAY. The CLIENT, if he so wishes, can then benefit from payment in two (2) instalments:

-an initial payment, when the order is placed, equal to 30% of the price of the STAY + booking fees + insurance costs (if applicable).

-a second payment equal to 70% of the price of the STAY, to be paid no later than 30 days before the start date of the STAY. In the case of payment by credit card, the CLIENT does not need to intervene, as the balance is automatically programmed.

In the event that the balance of a STAY is not received by the above-mentioned deadline, the STAY will be considered cancelled, and the cancellation conditions set out in article 5 will apply.

Reservations made less than 30 days before the start of the stay must be paid for by credit card or by Connect vacation vouchers (ANCV).

The deposit must be paid by credit card or Connect vacation vouchers (ANCV).

For payment of the balance, the following methods of payment may be used by the customer:

  • By credit card (Carte Bleue, VISA, or Mastercard) online on the website (secure payment);

    The CLIENT's credit card information (sixteen-digit credit card number, four-digit validity date, last three digits of the pictogram on the back of the credit card) will be fully protected and SSL encrypted, via the Payline secure payment platform.

    USV will not have access to the CLIENT's credit card number, except to obtain payment for the order.

  • ANCV vacation vouchers accepted in payment of rental services in France or for destinations in the European Union.

If this method of payment is used, the Chèques-Vacances ANCV must be duly completed and sent to the Company by registered letter with acknowledgement of receipt to the following address: USV, 10 Villa d'Eylau - 75116 PARIS. Vacation vouchers must be returned with their original stubs, detached from the checkbook and not stapled or taped to any support. The “Holder's name” field must be filled in.

Should this not be the case, the Company declines all responsibility in the event of loss or theft during the routing of the Customer's payment.

12.2 Payment of an order accepted less than thirty days before the start of the STAY :

All STAY reservations made less than thirty (30) days before the start date of the STAY must be paid in full in a single payment by card or Chèques-Vacances connect.

13 - Customer service / Customer complaints

Any complaint by a Customer regarding an Order must be notified in detail by registered letter with acknowledgement of receipt to USV no later than thirty (30) days after the end of the Stay by writing to the following address: USV, 10 Villa d'Eylau - 75116 PARIS or by e-mail to reclamation@ushuaia-villages.com. A copy of the complaint may be sent by the Customer to the Partner.

On arrival at the campsite, the customer is required to check the inventory and condition of the accommodation (inventory of equipment, condition of equipment and state of cleanliness). Any complaints must be reported on site to the campsite or accommodation manager. The customer has 24 hours in which to inform the person in charge and USV of any anomalies noted. After this time, the campsite will be considered free of damage when the customer enters the campsite, and complaints will no longer be accepted.

In addition, when a non-conformity in the execution of the services of the contract is noted on the spot, the customer is held to announce it to the reception and the head office of the company USV, as soon as possible, by telephone with 02 52 56 03 99, by email with the address reclamation@ushuaia-villages.com or by postal way with the address USV - 10 Villa d' Eylau - 75116 PARIS.

In all cases, no post-stay complaint will be taken into account if the facts have not been reported to the campsite representative on site or to USV's head office during the stay.

Our Customer Service Department will deal with your request within a maximum of 20 working days from the date of receipt of your letter.

Any request to review a file must be returned in writing by the customer within 14 days of the reply sent by e-mail or post by USV, failing which the file will be considered closed.

13.2 In the event of disagreement between the CUSTOMER and USV regarding the handling of their complaint, and less than one year after the CUSTOMER has made a written complaint to USV, the CUSTOMER has the right to use the mediation services MEDIATION TOURISME ET VOYAGES offered by USV.

The CLIENT may send his request for mediation to MEDIATION TOURISME ET VOYAGES electronically: https://www.mtv.travel/

Mediation is free of charge for the CLIENT, with the exception of the costs of a lawyer, expert or any other person whom the CLIENT chooses to involve in the mediation.

The European Commission has also set up a dispute resolution platform designed to collect any complaints from consumers following an online purchase, and then forward them to the relevant national mediators.

14 - Protection of personal data

Certain information and data concerning the CLIENT are collected on the SITE for the purposes of order management. This information may be transmitted to USV or to USV's partners in charge of processing and executing orders. This information and data is also kept for security purposes, in order to comply with legal and regulatory obligations.

The CLIENT is informed of this automated data processing. This file has been declared to the CNIL (French Data Protection Authority) under no. 54165. In accordance with French law no. 78-17 of January 6, 1978, as amended, the CUSTOMER has the right to oppose, access, modify, rectify and delete any personal data concerning him or her at any time, by going to the SITE, under the heading “My account” and logging in with his or her password, or by writing to USV: info@ushuaia-villages.com or USV - 10 Villa d'Eylau - 75116 PARIS - FRANCE.

In accordance with article L.223-2 of the French Consumer Code, the CLIENT may, if he/she so wishes, register on an opposition list to telephone canvassing available on the website www.bloctel.gouv.fr


15- Liability

Exoneration due to the CLIENT :

If there is no news from the CLIENT twenty-four (24) hours after the scheduled arrival date, USV may dispose of the rental accommodation. USV will retain the fees applicable in the event of cancellation under the conditions set out in article 5. In the event of late arrival, or early departure, in relation to the dates mentioned on the invoice sent to the CLIENT (voucher), no reimbursement will be made, unless the CLIENT has taken out insurance to cover this.

Exoneration of third party liability:

The information put online by USV concerning a campsite is based exclusively on the information and documents provided by the campsite. The campsite is the owner and has the right to use all documents provided. The campsite guarantees the authenticity of the information and that it is neither misleading nor deceptive. All documents provided must be legally free for use on the Internet. USV cannot be held liable for non-performance of these terms and conditions in the event of unavailability of service on the SITE, inconvenience or damage inherent in the use of the Internet network, in particular a break in service, external intrusion or the presence of computer viruses. Access to the SITE or to orders may be interrupted for maintenance reasons and/or for any other decision taken by USV. The SITE is subject to change without notice.

Exemption in the event of force majeure :

USV may not be held liable for non-performance of these terms and conditions in the event of force majeure as defined by established case law, in particular: internal or external power failures, or communications failures (computer network failure, etc.), all natural disasters on the STAY site, in particular all floods, fire, storms, hail and other major bad weather.

16- Applicable law

These terms and conditions are governed by French law. The total or partial nullity of any clause of these terms and conditions shall have no effect on the validity of the other provisions.

17- Reproduced legal provisions

In accordance with article R. 211-12 of the French Tourism Code, the provisions of articles R. 211-3 to R. 211-11 of the same code are reproduced below. They apply exclusively to the organization of travels, stays and tourist packages within the meaning of articles

L. 211-1 and L. 211-2 of the French Tourism Code.

Article R. 211-3

Subject to the exclusions set out in the third and fourth paragraphs of article L. 211-7, all offers and sales of travel or holiday services must be accompanied by appropriate documents that comply with the rules set out in the present section. In the case of the sale of air tickets or tickets for scheduled air travel not accompanied by services related to such travel, the seller shall issue the purchaser with one or more tickets for the entire journey, issued by the carrier or under its responsibility. In the case of transportation on demand, the name and address of the carrier, on whose behalf the tickets are issued, must be mentioned. Separate invoicing of the various elements of the same tourist package does not exempt the vendor from his obligations under the regulatory provisions of the present section.

Article R. 211-3-1
CGV-83-A

The exchange of pre-contractual information or the provision of contractual terms and conditions shall be made in writing. They may be made by electronic means under the conditions of validity and exercise set out in articles 1125 to 1127-6, 1176 and 1177 of the French

Civil Code. The name or company name and address of the seller are mentioned, together with an indication of his registration in the register provided for in a of article L. 141-3 or, where applicable, the name, address and indication of the registration of the federation or union mentioned in the second paragraph of article R. 211-2.

Article R. 211-4
Prior to the conclusion of the contract, the seller must provide the consumer with information on the prices, dates and other constituent elements of the services provided in connection with the trip or stay, such as:

1° The destination, means, characteristics and categories of transport used;

2° The type of accommodation, its location, level of comfort and main features, its certification and tourist classification in accordance with the regulations or customs of the host country;

3° Catering services offered;

4° A description of the itinerary in the case of a tour;

5° The administrative and health formalities to be completed by nationals of France or of another member state of the European Union or of a state party to the Agreement on the European Economic Area, particularly when crossing borders, and the time required to complete them;

6° Visits, excursions and other services included in the package or available at extra cost;
7° The minimum or maximum group size required for the trip or holiday and, if the trip or holiday is subject to a minimum number of participants, the deadline for informing the consumer in the event of cancellation of the trip or holiday; this date may not be less than twenty-one days before departure;

8° The amount or percentage of the price to be paid as a deposit on conclusion of the contract, and the schedule for payment of the balance;

9° The price revision terms and conditions as set out in the contract in application of

article R. 211-8 ;

10° Contractual cancellation conditions;

11° Cancellation conditions defined in articles R. 211-9, R. 211-10 and R. 211-11;

12° Information concerning the optional subscription of an insurance contract covering the consequences of certain cases of cancellation or an assistance contract covering certain specific risks, in particular repatriation costs in the event of accident or illness;

13° When the contract includes air transport services, the information, for each leg of the flight, provided for in articles R. 211-15 to R. 211-18.

Article R. 211-5
CGV-83-A
Prior information given to the consumer is binding on the seller, unless the seller has expressly reserved the right to modify certain elements of the information. In this case, the seller must clearly indicate the extent to which this modification may be made, and on which elements. In any event, changes to the prior information must be communicated to the consumer before the contract is concluded.

Article R. 211-6
The contract concluded between the seller and the buyer must be in writing, drawn up in duplicate, one of which is given to the buyer, and signed by both parties. When the contract is concluded electronically, articles 1125 to 1127-6, 1176 and 1177 of the French Civil Code apply.

The contract must include the following clauses:

1° The name and address of the seller, his guarantor and insurer, and the name and address of the organizer;

2° The destination or destinations of the journey and, in the case of a split holiday, the different periods and their dates;

3° The means, characteristics and categories of transport used, and the dates and places of departure and return;

4° The type of accommodation, its location, level of comfort and main features, and its tourist classification under the regulations or customs of the host country

5° The catering services offered;

6° Itinerary in the case of a tour;
7° Visits, excursions or other services included in the total price of the trip or stay

8° The total price of the services invoiced, as well as an indication of any revision of this invoicing pursuant to the provisions of article R. 211-8;

9° An indication, where applicable, of any fees or taxes relating to certain services, such as landing, disembarkation or embarkation taxes in ports and airports, and tourist taxes when they are not included in the price of the service(s) provided;

10° The schedule and terms of payment of the price; the last payment made by the purchaser may not be less than 30% of the price of the trip or stay, and must be made on delivery of the documents required for the trip or stay;

11° Any special conditions requested by the buyer and accepted by the seller;

12° The terms and conditions under which the purchaser may lodge a complaint with the vendor for non-performance or improper performance of the contract, which complaint must be sent as soon as possible, by any means enabling an acknowledgement of receipt to be obtained, to the vendor, CGV-83-A and, where applicable, notified in writing, to the travel organizer and service provider concerned;

13° The deadline for informing the purchaser in the event of cancellation of the trip or holiday by the vendor, where the trip or holiday is linked to a minimum number of participants, in accordance with the provisions of 7° of article R. 211-4;

14° Contractual cancellation conditions;

15° Cancellation conditions stipulated in articles R. 211-9, R. 211-10 and R. 211-11;

16° Details of the risks covered and the amount of guarantees under the insurance contract covering the consequences of the seller's professional civil liability;

17° Information concerning the insurance contract covering the consequences of certain cases of cancellation taken out by the buyer (policy number and name of insurer), as well as information concerning the assistance contract covering certain specific risks, in particular repatriation costs in the event of accident or illness; in this case, the seller must provide the buyer with a document specifying at least the risks covered and the risks excluded;

18° The deadline for informing the seller in the event of transfer of the contract by the buyer;

19° An undertaking to provide the purchaser, at least ten days before the planned date of departure, with the following information:

a) The name, address and telephone number of the seller's local representative or, failing that, the names, addresses and telephone numbers of local organizations likely to be able to help the consumer in the event of difficulty or, failing that, the telephone number for urgent contact with the seller;

b) For trips and stays abroad for minors, a telephone number and address enabling direct contact to be made with the child or the person in charge of the child's stay;

20° A clause allowing cancellation and reimbursement, without penalty, of sums paid by the purchaser in the event of failure to comply with the obligation to provide the information stipulated in 13° of article R. 211-4 ;

21° A commitment to provide the purchaser with departure and arrival times in good time before the start of the trip or holiday.

Article R. 211-7
The purchaser may assign his contract to a transferee who fulfils the same conditions as he does to take the trip or stay, as long as this contract has not produced any effect.

Unless otherwise stipulated, the assignor must inform the seller of his decision by any means capable of producing an acknowledgement of receipt no later than seven days before the start of the trip. In the case of a cruise, this period is extended to fifteen days.

Under no circumstances is this transfer subject to prior authorization by the seller.

Article R. 211-8
When the contract provides for the express possibility of revising the price, within the limits set out in article L. 211-12, it must mention the precise methods used to calculate price variations, both upwards and downwards, and in particular the amount of transport costs and related taxes, the currency or currencies that may affect the price of the trip or stay, the portion of the price to which the variation applies, and the exchange rate of the currency or currencies used as a reference when establishing the price shown in the contract.

Article R. 211-9
When, prior to the buyer's departure, the seller is forced to make a change to one of the essential elements of the contract, such as a significant price increase, and when he fails to comply with the obligation to provide information mentioned in 13° of article R. 211-4,

the purchaser may, without prejudice to any claims for damages, and after having been informed by the seller by any means capable of producing an acknowledgement of receipt :

-or cancel the contract and obtain immediate reimbursement of the sums paid, without penalty

Article R. 211-10
In the case provided for in article L. 211-14, when, before the buyer's departure, the seller cancels the trip or holiday, he must inform the buyer by any means that will enable him to obtain an acknowledgement of receipt; the buyer, without prejudice to any claims for compensation for any damage suffered, obtains from the seller an immediate refund without penalty of the sums paid; in this case, the buyer receives compensation at least equal to the penalty he would have incurred if the cancellation had been made.

the purchaser, without prejudice to any claims for damages, shall obtain from the seller immediate reimbursement of the sums paid, without penalty; in this case, the purchaser shall receive compensation at least equal to the penalty he would have incurred if the cancellation had been made by him on that date. The provisions of the present article shall in no way prevent the conclusion of an amicable agreement for the purpose of the buyer's acceptance of a substitute trip or stay proposed by the seller.

Article R. 211-11
When, after the buyer's departure, the seller finds himself unable to provide a preponderant part of the services provided for in the contract, representing a non-negligible percentage of the price paid by the buyer, the seller must immediately take the following measures

either offer services to replace the services provided, possibly at an additional cost, and if the services accepted by the buyer are of inferior quality, the seller must reimburse the buyer for the difference in price as soon as the buyer returns;

-or, if the seller is unable to offer any replacement services or if these are refused by the purchaser for valid reasons, provide the purchaser, at no extra cost, with tickets for the return journey to the place of departure or to another place accepted by both parties, under conditions that can be deemed equivalent. The provisions of the present article are applicable in the event of non-compliance with the obligation set out in 13° of article R. 211-4.
